Jason Kilene joined Gustafson Gluek in 2003, shortly after the Firm opened its doors. As one of the first attorneys to join Gustafson Gluek, Jason has been an integral part of the growth of the Firm. As a Member of Gustafson Gluek, Jason has worked on a wide variety of cases in the areas of antitrust, consumer protection and other complex litigation. He has developed a network of attorneys across the country who reach out to him when they have one of these potential cases that they would like the Firm to get involved with.
Over the years at Gustafson Gluek, Jason has been involved in several significant cases including In re Automotive Parts Antitrust Litig. (E.D. Mich.), leading the Gustafson Gluek team in representing a class of indirect purchasers of various automotive components. This case ultimately settled for over $1.2 billion for the class. Jason was also involved in the In re Payment Card Interchange Fee and Merchant Discount Litig. (E.D.N.Y), in which plaintiffs alleged that Visa, MasterCard and a number of their member banks conspired to fix the price of the interchange fees charged to the merchants who accepted those cards. This case ultimately settled for over $6.2 billion. These are just two of the many important cases that Jason has worked on while at the Firm. Jason also plays a significant role in identification, investigation, initiation and development of complex class action matters, along with his substantial involvement with client relations.
Jason is admitted to the Minnesota Bar, North Dakota Bar and is admitted to practice in the United States District Court for the District of Minnesota and the District of North Dakota. He is also a member of the Hennepin County, Minnesota, North Dakota, and Federal Bar Associations.
Jason earned his J.D. with distinction from the University of North Dakota School of Law and clerked for the Honorable Bruce M. Van Sickle in the United States District Court for the District of North Dakota. Prior to joining Gustafson Gluek, Jason represented numerous clients in the areas of commercial and complex litigation.
When Jason is not working, he can often be found on the golf course – either in Minnesota during the summer months or Arizona during the winter ones. Jason also enjoys traveling, skiing, and on occasion has been known to enjoy a nice steak with a glass of wine and a cigar.

Jason has worked on many cases in which the firm had an active leadership role, including antitrust, consumer protection and product liability cases, among others. Jason was actively involved in representing a class of individuals and small businesses who purchased auto parts at artificially inflated prices in In re Automotive Parts Antitrust Litig. (E.D. Mich.). This nationwide class action alleged numerous separate conspiracies in the markets for a variety of different auto parts. The U.S. Department of Justice brought criminal charges relating to these conspiracies and obtained approximately $2.8 billion in criminal fines. To date, there have been settlements exceeding $1 billion for class members.
As part of the Executive Committee in In re Payment Card Interchange Fee and Merchant Discount Litig. (E.D.N.Y), Jason also played a major role in depositions and discovery against one of the bank defendants. The case ultimately settled for over $6.2 billion.
Jason has also been involved in In re Transpacific Passenger Air Transportation Antitrust Litig. (N.D. Cal.), representing consumers who allege that they were charged artificially inflated air passenger fees as a result of a conspiracy between the defendant airlines. There have been settlements of over $130 million.
Jason acted as a discovery team lead in In re Domestic Drywall Antitrust Litig. (E.D. Pa.) while representing direct purchasers of drywall who alleged the dominant drywall manufacturers in the United States conspired to fix drywall prices. Settlements in this case totaled over $190 million for the class.
