Gustafson Gluek attorneys Dan Gustafson, Karla Gluek, and Joe Bourne co-authored an article, Pro Se Litigation and the Costs of Access to Justice, 39 Wm. Mitchell L. Rev. 32 (2012). The article explains that many civil litigants appear pro se because of the high cost of representation. This disadvantages pro se litigants whose adversaries are represented by counsel, and requires additional judicial resources to enable pro se litigants to move through the system.The Minnesota Federal Pro Se Project has had success pairing pro se litigants with volunteer attorneys, but many remain unrepresented in court. The authors suggest that guaranteed public funding of the Pro Se Project and reimbursement of volunteer attorneys’ costs would further incentivize attorney participation and would be an important next step toward the goal of having counsel available for all litigants regardless of their financial status.
