Dan Gustafson Co-Authors 8th Circuit Amicus Brief for AAI

Today, the American Antitrust Institute filed an amicus curiae brief co-authored by Dan Gustafson. The brief was filed with the Eighth Circuit Court of Appeals in D&G, Inc. v. SuperValue Inc. and asks the Court to clarify Eighth Circuit law to ensure (1) naked, horizontal customer allocation remains in the per se category of Sherman Act offenses, and (2) any form of horizontal market allocation must be found ancillary to a legitimate and competitive business association before the rule of reason will be substituted for the per se rule.For additional details, you can review the brief here.
