Tony Stauber joined Gustafson Gluek PLLC as an associate in 2021. Since joining the Firm, Tony has vigorously advocated on behalf of individuals and businesses who have been the victims of price-fixing, abuses of monopoly power, and other anticompetitive conduct. In addition to antitrust law, Tony also practices in the areas of civil rights and consumer protection. He is passionate about pursuing claims on behalf of his clients who have been harmed by institutions of power – whether those are gigantic corporations or law enforcement agencies.

Tony has substantial experience working on large, complex antitrust cases including Ray v. NCAA (E.D. Cal.) where he represented a class of former Division I collegiate athletics coaches who were illegally restricted from receiving any compensation for their labor. Tony and co-counsel negotiated a settlement of $303 million dollars, which represented the virtually unprecedented result of repaying class members every penny they lost as a result of the NCAA’s conspiracy.

Tony is also active in antitrust cases in the agriculture and raw materials sectors, including In re Cattle & Beef Antitrust Litig. (D. Minn.) and In re Broiler Chicken Antitrust Litig. (N.D. Ill.), which involved horizontal conspiracies in the beef and chicken industries, respectively. For the latter, Tony was a central part of the trial preparation team that settled all remaining claims on the eve of trial and for which he received recognition for Outstanding Antitrust Litigation Achievement by a Young or Newly Admitted Lawyer Award by the American Antitrust Institute in 2025.

In addition to working on significant antitrust cases, Tony has worked on pro bono cases alleging constitutional and civil rights violations by state and local governments. Among those cases, Tony represented a peaceful protester who was subjected to excessive force by law enforcement, for which he successfully defended denial of qualified immunity and denial of motion to dismiss at the 8th Circuit Court of Appeals. Wolk v. City of Brooklyn Center (D. Minn.). Tony has also been actively involved in several long-running cases challenging the constitutionality and practices of the Minnesota Sex Offender Program. Karsjens v. Piper (D. Minn.); Rud v. Johnston (D. Minn.). Tony has been recognized as a North Star Lawyer each year from 2022 through 2025, for providing at least 50 hours of pro bono time in a single year.   

Tony is an active member of the Minnesota and Federal Bar associations and has been heavily involved in other legal organizations, including serving as co-chair of the Amicus Committee for the Committee to Support the Antitrust Laws (COSAL) from 2024-2025. He has authored amicus curiae briefs on behalf of COSAL in significant cases such as Scharpf v. General Dymanics Corp. (4th Cir.), World Association of Icehockey Players Unionsv. NHL (9th Cir.). Tony also represented and authored the amicus curiae brief on behalf of Antitrust Law Scholars in In re NFL Sunday Ticket Antitrust Litig. (9th Cir.). He has also contributed to chapters in the American Bar Association’s Rule of Reason Handbook (2026) and the Antitrust Law Developments (10th Edition, forthcoming). In 2023, Tony was selected as an “Up & Coming Attorney” by Minnesota Lawyer.

Tony graduated from the University of Minnesota with a B.A. in English Literature. He graduated magna cum laude from Mitchell Hamline School of Law. Tony remains an active member of the National Speech and Debate Association and the Minnesota State High School League as a speech and debate coach.

Tony is a proud resident of Minneapolis along with his wife, their cat, and French bulldog. In his free time, Tony is an avid woodturner and a film buff and enjoys frequenting the many independent movie theaters around the Twin Cities.

  • Currently, Tony is a vital part of the Gustafson Gluek team representing class of direct purchasers of boxed beef in the In re Cattle and Beef Antitrust Litigation (D. Minn.). Gustafson Gluek is one of four Co-Lead Counsel of the direct purchaser class who are alleging the Defendants conspired to fix and maintain the price of beef in violation of the federal antitrust laws. That case remains ongoing and has resulted in over $130 million for the DPP class to date.

    Tony was also part of the Gustafson Gluek team that represented a class of Consumer and Institutional Indirect Purchaser Plaintiffs in In re Broiler Chicken Antitrust Litigation (N.D. Ill.). Gustafson Gluek was one of four Co-Lead Counsel in this action which culminated on the eve of trial with total settlements exceeding $140 million.

    As noted above, Tony’s pro bono work is also very important to him. He was part of the litigation team that has been litigating constitutional rights violations on behalf of a class of individuals who have been indefinitely committed to the Minnesota Sexual Offender Program. This case began in 2010 and has proceeded to the Eighth Circuit Court of Appeals four times and remains active to date. Karsjens v. Piper (D. Minn).

    Tony has also represented protesters in class and individual cases who were brutalized by police in retaliation for exercising their First Amendment rights. Settlements in both Samaha v. City of Minneapolis (D. Minn) and Wolk v. City of Brooklyn Center (D. Minn) have resulted in substantial injunctive relief, including policy changes within the Minneapolis Police Department and Minnesota State Patrol. Tony presented an oral argument in front of the Eighth Circuit Court of Appeals defending the district court’s denial of the defendants’ motion to dismiss.

    Finally, Tony is a part of the Gustafson Gluek team that has brought lawsuits against the Minnesota Department of Human Services for their ongoing practice of illegally detaining mentally ill criminal defendants in local jails, often for months, rather than transferring them to hospitals for treatments. Dalen v. Harpstead (D. Minn.).
