Court Grants Plaintiff Summary Judgment on 3M’s Military Contractor Defense

Gustafson Gluek recently obtained a significant Summary Judgment Order from the Hennepin County Court relating to the litigation against 3M involving the Combat Arms Earplugs version 2 (CAEv2). Specifically, Judge Miller determined that the federal government contractor defense was not available because 3M could not prove that the United States Military had been adequately involved in the creation of the warnings of the earplugs.
