Judge Denied Defendants’ Motion To Dismiss Pork Antitrust Case

On October 16, 2020, Chief Judge John R. Tunheim of the District of Minnesota denied Defendants’ joint motion to dismiss, in In Re Pork Antitrust Litigation, finding that the Plaintiffs adequately plead in their Amended Complaints that the Defendants engaged in a price-fixing conspiracy to artificially constrict the supply of pork products in the U.S. in violation of the Sherman Act.

Gustafson Gluek is Co-Lead Counsel for the Consumer Indirect Purchaser Plaintiff class, representing individuals who purchased pork products.

The Court dismissed only one Defendant, Indiana Packers’ Corporation. The remaining Defendants are Agri Stats, Inc.; Clemens Food Group, LLC and The Clemens Family Corporation; Hormel Foods Corporation and Hormel Foods, LLC; JBS USA Food Company; Seaboard Foods LLC and Seaboard Corporation; Smithfield Foods, Inc.; Triumph Foods, LLC; and Tyson Foods, Inc., Tyson Fresh Meats, Inc. and Tyson Prepared Foods, Inc.
