Additional Settlements in Freight Forwarder Antitrust Litigation
The Court has granted preliminary approval of settlements with six more defendant groups in Precision Associates, Inc. v. Panalpina World Transport (Holding) Ltd., which is currently pending in the U.S. District Court for the Eastern District of New York. The Court has also granted final approval of previous settlements with ten defendant groups. If the most recent settlements receive final approval, the recovery for members of the Class will be over $178 million and may increase as certain funds assigned from the Air Cargo litigation are received. The litigation remains ongoing against the remaining defendant groups. Gustafson Gluek PLLC, as Co-Lead Counsel, represents the Plaintiffs and Class members in the ongoing litigation as well as the settlements.In this litigation, Plaintiffs have asserted claims on behalf of a proposed direct purchaser class against a number of freight forwarders for allegedly conspiring, in violation of the antitrust laws, to fix the prices for various charges and surcharges associated with providing freight forwarding services throughout the world, including on routes between the U.S. and China, Hong Kong, Japan, and the U.K. Freight forwarding services are services relating to the organization or transportation of items via air and ocean, both nationally and internationally, and related activities such as customs clearance, warehousing, and ground services. Providers of such freight forwarding services are sometimes referred to as “third party logistics providers.”Class members must submit their claims by August 24, 2015, in order to participate in the settlements.
