Court Certifies Classes of Disposable Contact Lenses

On December 4, 2018, Judge Schlesinger for the Middle District of Florida certified several classes of purchasers of certain disposable contact lenses manufactured by Defendants Alcon Laboratories, Inc., Johnson & Johnson Vision Care, Inc., and Bausch & Lomb Inc. Judge Schlesinger certified four nationwide classes and two state classes of purchases from Maryland and California. This case alleges that Defendants Alcon Laboratories, Inc., Johnson & Johnson Vision Care, Inc., and Bausch & Lomb Inc. adopted, implemented, and enforced pricing policies that reduced or eliminated price competition on disposable contact lenses from other retailers by preventing other retailers from discounting their products.
